| Minecraft server | haven.smpserver.net |
| Discord | https://discord.gg/HQzQRNGcuD |
| Website | https://havensmp.co.uk/ |
Unless otherwise stated, references to "Haven", "Haven SMP", "we", "us" or "our" mean the operator identified above.
Haven SMP is not affiliated with, sponsored by, endorsed by, or otherwise officially connected with Mojang Studios or Microsoft.
2. Eligibility and Age Requirement
Haven SMP is an 18+ community.
You must be aged 18 or over to access or use the Services. By applying for a whitelist, joining the Discord server, connecting to the Minecraft server or otherwise using the Services, you confirm that you meet this age requirement.
Age is currently self-declared. Haven SMP does not ordinarily carry out formal identity or age verification.
If we reasonably believe that a person under 18 is using the Services, we may suspend or terminate their access and take appropriate steps concerning personal data associated with that account, subject to our Privacy Policy and applicable law.
3. Definitions
For these Terms:
"Account" means a Minecraft account, Discord account or other account used to access the Services.
"Rules" means the Haven SMP community rules published on our website and in our Discord server, as updated from time to time.
"Server" means the Haven SMP Minecraft server and its associated infrastructure.
"Subscription" means a Virtual Item supplied on a recurring basis in exchange for a periodic payment.
"Virtual Items" means virtual ranks, tags, currency, items, permissions, cosmetic features, digital entitlements or other in-game benefits made available through the Services.
"RMT" means real-money trading, being the exchange or attempted exchange of Virtual Items, accounts, access, services or other in-game benefits for money or other real-world consideration, except through an official Haven SMP purchase process.
"Staff" means Haven SMP administrators, moderators and other persons authorised by Haven SMP to administer the Services.
4. Access to the Services
Access to Haven SMP may be subject to a whitelist application, account eligibility requirements and compliance with these Terms and the Rules.
The Rules form part of these Terms and are incorporated into them by reference. The Rules are published on our website and in our Discord server, and may be updated in accordance with section 16.
Where these Terms and the Rules conflict, these Terms prevail. Where the Rules address a matter in more detail than these Terms, the Rules apply to that detail.
We may refuse or restrict access where reasonably necessary to:
- protect the security or integrity of the Services;
- prevent abuse, cheating, fraud, harassment or other misconduct;
- enforce these Terms or the Rules;
- investigate suspected rule violations;
- comply with legal obligations; or
- protect the legitimate interests of Haven SMP, its Staff or other users.
We do not guarantee that access to the Services will always be available or uninterrupted.
5. Rules and Prohibited Conduct
You must not use the Services in a manner which materially interferes with other users' enjoyment, compromises the security or integrity of the Services, or breaches these Terms or the Rules.
5.1 Cheats, unauthorised modifications and automation
Unless expressly permitted by Haven SMP:
- hacked or modified clients that provide an unfair gameplay advantage are prohibited; movement, inventory, combat, health, radar, ESP, freecam or similar advantage-providing modifications are prohibited;
- auto-clickers, macros, scripts, automation tools and similar systems are prohibited where they provide an unfair advantage or automate gameplay;
- "easy-place", automated building or equivalent functionality providing an unfair advantage is prohibited;
- exploiting unintended client or server functionality to obtain an unfair advantage is prohibited.
Cosmetic, accessibility or performance modifications may be permitted where they do not provide an unfair advantage. Haven SMP may publish additional guidance identifying permitted or prohibited modifications.
5.2 Bugs, exploits and duplication
You must not intentionally abuse, reproduce or distribute a server bug, exploit or vulnerability for an improper purpose.
This includes, without limitation:
- item or currency duplication;
- bypassing intended gameplay restrictions;
- exploiting an unintended method of obtaining Virtual Items or other benefits; and
- deliberately assisting another person to exploit a known vulnerability.
Material bugs, exploits and security vulnerabilities should be reported to Staff.
5.3 Economy and trading
You must not:
- engage in RMT;
- trade Haven SMP accounts, Virtual Items, currency, access or services for real-world value outside an official Haven SMP purchase process;
- conduct unauthorised cross-server trading where Haven SMP has prohibited it;
- operate or promote external gambling involving Haven SMP Virtual Items or benefits;
- offer or accept Discord boosts, invites or other external benefits in exchange for prohibited in-game benefits;
- sell, transfer or purchase Haven SMP accounts except where expressly authorised by Haven SMP.
5.4 Identity and account abuse
Alternative accounts ("alts") are not permitted. Each person may use one Minecraft account and one Discord account to access the Services. Operating, or attempting to operate, any additional account is a breach of these Terms regardless of the reason for doing so, and regardless of whether the additional account is used to gain any advantage.
If you have a legitimate reason to change the account you use — for example, because an account has been compromised or you have migrated to a new Minecraft account — you must contact Staff before connecting with the new account so that your whitelist record can be updated.
You must also not:
- impersonate Staff or falsely represent yourself as being affiliated with Haven SMP;
- use another person's account without permission;
- attempt to obtain another person's account credentials;
- evade a sanction using another account or by misrepresenting your identity;
- attempt to obtain, reconstruct or use the Server's world seed except where expressly authorised.
Where we reasonably believe that multiple accounts are controlled or operated by the same person, action may be taken against all associated accounts.
5.5 Harassment and disruptive conduct
You must not use the Services to:
- harass, threaten, intimidate or repeatedly target another person;
- engage in discriminatory or hateful abuse;
- deliberately disrupt gameplay, voice chat or community services;
- spam or excessively misuse voice or text communication channels;
- send malicious links, malware or other harmful content;
- conduct doxxing, stalking or other serious invasions of another person's privacy.
Nothing in this section prevents legitimate criticism, disagreement or appeals conducted in a reasonable manner.
5.6 Conduct resulting in immediate action
Certain conduct is treated as sufficiently serious that immediate action may be taken without a prior warning, including:
- threats or attempts to carry out denial-of-service (DDoS) attacks against Haven SMP, its infrastructure or its users, including where stated as a joke;
- doxxing, or threats to publish another person's personal information;
- obtaining or attempting to obtain the Server's world seed.
Conduct falling within this section may result in a permanent ban and, where reasonably necessary to protect the Services, an IP-level restriction.
6. Account Security
You are responsible for taking reasonable steps to protect your Minecraft and Discord accounts.
You must not deliberately share credentials where doing so could compromise your account or another person's access.
Haven SMP is not responsible for losses caused solely by your failure to maintain reasonable account security, subject always to any liability that cannot lawfully be excluded or limited.
7. Moderation and Enforcement
Haven SMP may investigate suspected violations of these Terms or the Rules and may take proportionate action, including:
- warnings;
- temporary restrictions;
- mutes or communication restrictions;
- removal of prohibited content;
- removal of Virtual Items or improperly obtained benefits;
- temporary suspensions;
- permanent bans;
- IP-level restrictions, where reasonably necessary to prevent repeated access following a permanent ban or to address a serious security risk; or
- other reasonable measures necessary to protect the Services.
7.1 Human review
Haven SMP uses automated technical systems, including anti-cheat checks, to help identify possible rule violations.
No permanent ban is issued on the basis of an automated system alone. Where an automated system flags an account, a member of Staff reviews the relevant information before a permanent sanction is applied. Automated systems may trigger a temporary, precautionary restriction pending that review.
7.2 Immediate action
We may take action without giving prior notice where immediate action is reasonably necessary to protect the community, investigate serious misconduct, prevent evidence from being destroyed, address security risks or comply with legal obligations.
Where reasonably practicable, less serious matters may be addressed through warnings or an opportunity to correct the behaviour.
Enforcement decisions may take account of the seriousness, duration and consequences of the conduct, the user's previous history, whether the conduct was deliberate, and any relevant mitigating circumstances.
8. Appeals
You may appeal a moderation decision by opening a ticket in the Haven SMP Discord server: https://discord.gg/HQzQRNGcuD
Appeals should contain sufficient information for Staff to identify the relevant account and decision, including your Minecraft username and, where known, the approximate date of the decision.
Haven SMP aims to review appeals fairly and consistently. Internal appeal decisions are final within Haven SMP's internal moderation process, but this does not remove or limit any legal rights you may have.
9. Virtual Items and Digital Entitlements
Virtual Items are digital entitlements that permit you to access or use particular features of the Services.
Except where applicable law provides otherwise, you do not acquire ownership of Haven SMP's server infrastructure, databases, software, systems or intellectual property merely by receiving a Virtual Item.
Where a Virtual Item is provided to you, you receive a limited, personal, non-exclusive and non-transferable permission to use that Virtual Item within the Services for as long as the relevant entitlement remains available.
We may make reasonable changes to Virtual Items, including changes required for balancing, technical reasons, security, compatibility, legal compliance or the continued operation of the Services.
We may remove or suspend Virtual Items where they were obtained through fraud, abuse, exploitation, unauthorised transfer, a reversed payment or a serious breach of these Terms.
Nothing in this section removes a consumer's statutory rights, including rights relating to paid digital content which is faulty, not as described or otherwise fails to conform to the contract.
10. User Content
You retain ownership of intellectual property rights that you lawfully own in content you create or submit to Haven SMP, unless you expressly transfer those rights.
By submitting content to the Services, you grant Haven SMP a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and technically process that content only to the extent reasonably necessary to operate, secure, moderate and promote the Services. This includes featuring screenshots of in-game builds in our Build Gallery, where you have submitted them for that purpose.
This licence does not transfer ownership of your underlying intellectual property.
You must not submit content which infringes another person's intellectual property, privacy or other legal rights.
10.1 Reporting infringing content
If you believe that content hosted by Haven SMP infringes your intellectual property or other legal rights, contact us at matthewhaff3@gmail.com with:
- a description of the material and where it appears;
- an explanation of the right you say has been infringed;
- confirmation that the complaint is made in good faith; and
- contact details on which we can reach you.
We will review complaints promptly and, where a complaint appears well founded, remove or restrict access to the material concerned.
10.2 Build Gallery
Where you submit a screenshot for inclusion in the Build Gallery, you confirm that you have the right to do so. Submitting a screenshot does not guarantee that it will be featured. If you would like a featured screenshot removed, contact Staff and we will remove it.
11. Server Availability and Changes
Haven SMP may modify, suspend or discontinue all or part of the Services where reasonably necessary.
Examples include:
- maintenance;
- technical upgrades;
- security incidents;
- balancing changes;
- software or hosting changes;
- changes to Minecraft or third-party services;
- legal or regulatory requirements; or
- circumstances outside our reasonable control.
We will try to give reasonable notice of significant planned changes where reasonably practicable.
Where a paid digital entitlement is materially affected, any applicable statutory rights remain unaffected.
12. Third-Party Services
The Services may depend on or interact with third-party platforms, including Minecraft, Mojang/Microsoft services, Discord, Tebex and hosting or infrastructure providers.
Those services are operated under their own terms and policies.
Haven SMP is not responsible for the independent operation, availability or policies of third-party services.
You must comply with the applicable terms of those third parties when using their services.
13. Purchases
Purchases are processed through Tebex, which acts as the merchant of record and is the seller of the digital content you purchase.
Tebex's own terms state that you are purchasing from Tebex Limited — a company registered in England and Wales under company number 08129184 — unless you both reside in the United States of America and pay by credit or debit card, in which case you are purchasing from Tebex Inc. The entity acting as seller is identified at checkout.
13.1 Who your purchase contract is with
When you buy through the store, your purchase contract is with Tebex, not with Haven SMP. Tebex's terms state that no contract is formed between you and the platform — that is, Haven SMP — in respect of that purchase.
Haven SMP's role is to deliver the corresponding entitlement within the Haven SMP Services. These Terms govern your use of that entitlement once it has been delivered.
13.2 Which terms apply to a purchase
Purchases are subject to Tebex's purchase terms, available at https://checkout.tebex.io/terms, as well as these Terms so far as they concern your use of Haven SMP.
Tebex's terms state that, where they conflict with any other terms applying to a purchase, Tebex's terms take priority. Accordingly, in relation to the purchase contract itself — including payment, the identity of the seller, delivery of the licence, and refunds — Tebex's terms prevail over these Terms.
These Terms continue to govern your access to and conduct on the Haven SMP Services, including what happens to a Virtual Item after it has been delivered.
13.3 Pricing and other purchase information
Prices displayed on our website are shown both exclusive and inclusive of VAT. The final price payable, including any tax applicable in your location, is confirmed by Tebex at checkout.
Ranks, tags and similar packages are cosmetic and do not confer a gameplay advantage.
For information concerning refunds, cancellation rights and consumer remedies, see the Haven SMP Refund and Cancellation Policy and the applicable Tebex terms.
Nothing in these Terms is intended to remove or restrict statutory consumer rights.
14. Subscriptions
Some Virtual Items, including the Haven and Haven+ ranks, are supplied as monthly Subscriptions.
14.1 Recurring payment
Where you purchase a Subscription:
- payment is taken on a recurring monthly basis until the Subscription is cancelled;
- each payment covers one month of access to the relevant Virtual Item;
- the Subscription renews automatically at the end of each monthly period unless cancelled beforehand;
- the price and billing interval are those shown at checkout;
- Tebex confirms the amount and the billing frequency to you at checkout and in an email sent once the Subscription is set up, and its published process also issues reminders in connection with renewal and failed payments.
Subscription billing is administered by Tebex. Not every payment method supports recurring billing; the methods available for Subscriptions are those offered by Tebex at checkout and currently include PayPal and credit or debit cards.
14.2 Cancelling a Subscription
You may cancel a Subscription at any time. Tebex's terms provide two routes: the cancel link in any subscription email Tebex sends you, or your payment history at https://checkout.tebex.io/payment-history. You may also contact Haven SMP support and we will assist you.
Cancelling stops any further payment being taken. What then happens to the rank itself is governed by these Terms:
Cancellation takes effect at the end of the monthly period you have already paid for. Tebex records a cancelled Subscription as remaining active until that period ends. You keep the benefits of the Subscription until that period ends, after which the associated rank and its features are removed and no further payment is taken.
Cancelling does not, by itself, entitle you to a refund of the current month, but this does not affect any statutory right to a refund or other remedy where one arises.
14.3 Failed or reversed payments
If a renewal payment fails, the Subscription is not cancelled straight away. Tebex will:
- attempt the payment up to three times in total;
- email you reminders so that you have an opportunity to update your payment details; and
- keep the Subscription active during a short grace period while it attempts to collect payment.
Your rank remains active throughout this period. You do not lose access simply because a single payment attempt has failed.
If all payment attempts are unsuccessful, the Subscription ends, no further payments are taken, and the associated rank and its features are removed.
If a completed payment is later reversed or charged back, the associated rank and its features may be suspended or removed. See section 11 of the Refund and Cancellation Policy.
If a payment issue is resolved after your rank has been removed, contact Haven SMP support and we will restore the entitlement where reasonably possible. You may also simply purchase the Subscription again.
14.4 Changing rank
Purchasing a higher rank applies that rank in addition to any rank you already hold.
If you want to move from one rank Subscription to another rather than hold both, contact Haven SMP support before purchasing. Depending on what Tebex's subscription management allows at the time, this may involve cancelling the existing Subscription and starting the new one. We will help you arrange the change so that you are not left paying for two Subscriptions at once, or without a rank in between.
14.5 Lifetime purchases
Where a package is described as "lifetime", "permanent" or similar — including the Custom Rank — it is a one-off purchase and is not a Subscription. Section 7 of the Refund and Cancellation Policy explains what "lifetime" means in this context.
15. Liability
The Services are provided with reasonable care and skill where a legal duty to do so applies, but uninterrupted or error-free operation cannot be guaranteed.
To the fullest extent permitted by applicable law, Haven SMP will not be responsible for indirect or consequential loss that you could not reasonably have contemplated when entering into the relevant agreement.
15.1 Limit on our liability
Subject to sections 15.2 and 15.3, where Haven SMP is found liable to you in connection with the Services, our total liability to you is limited to the greater of:
- the total amount you have paid in connection with the Services in the twelve months immediately before the event giving rise to the liability; or
- £250.
This limit applies to all claims taken together, however they arise.
15.2 Where this limit does not apply
The limit in section 15.1 does not apply to:
- any remedy to which you are entitled under the Consumer Rights Act 2015 or other consumer protection legislation, including a refund, price reduction, repair or replacement in respect of paid digital content;
- the cost of putting right a failure to supply, or a defect in, digital content you have paid for; or
- anything listed in section 15.3.
If a court or other competent authority decides that the limit in section 15.1 is unfair or unreasonable in the circumstances, that limit does not apply to the claim concerned, and the remainder of these Terms continues in force.
15.3 Liability we do not exclude
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any liability which cannot legally be excluded or limited; or
- any statutory consumer right or remedy which cannot lawfully be excluded.
Where you are a consumer, nothing in these Terms limits rights or remedies available to you under applicable consumer protection legislation. Where any limit in section 15.1 would have the effect of restricting such a right or remedy, that limit does not apply to it (see section 15.2).
16. Indemnity
Nothing in these Terms requires a consumer to compensate Haven SMP for losses merely because they have exercised a statutory right.
Where permitted by law, you may be responsible for losses reasonably incurred by Haven SMP where those losses arise directly from your unlawful use of the Services, fraud, deliberate misuse, or infringement of another person's rights.
Any such responsibility is subject to applicable law.
17. Changes to These Terms
We may update these Terms and the Rules from time to time.
Minor changes, including corrections, clarifications, security updates and changes which do not materially disadvantage users, may take effect when published.
Where we make a material change which is reasonably likely to adversely affect existing users, we will provide reasonable advance notice where practicable, normally through the Discord server, website or in-game announcements.
Each version of these Terms carries a version number and effective date. The version applicable to you will normally be the version in force when you access the relevant Services, subject to any mandatory legal requirements concerning contractual changes. Superseded versions are archived and available on request.
Where a material change affects an active Subscription, you may cancel that Subscription in accordance with section 14.2 if you do not wish to continue under the revised Terms.
18. Suspension or Termination of the Services
You may stop using the Services at any time.
We may suspend or terminate your access in accordance with these Terms.
18.1 Effect on an active Subscription
If your access is suspended or permanently terminated while you hold an active Subscription:
- the Subscription should be cancelled so that no further payments are taken. We will cancel it where we are able to; otherwise contact Tebex or Haven SMP support and we will help you do so;
- the remainder of the period you have already paid for is not automatically refunded where the suspension or termination results from your breach of these Terms. The digital content was supplied to you as described, and the reason you can no longer use it is your own breach;
- where a suspension is later reversed on appeal, we will restore the entitlement and, where the Subscription has lapsed in the meantime, help you reinstate it without loss of the period concerned.
Nothing in this section removes any statutory right or remedy you may have, including where the digital content was faulty, not as described or otherwise did not conform to the contract. Refund requests are determined by Tebex as seller, in accordance with its terms and applicable law. Section 8 of the Refund and Cancellation Policy explains this in more detail.
If Haven SMP permanently ceases operating, access to Virtual Items and other server-specific entitlements will ordinarily end because the Services through which those entitlements are used will no longer exist.
This does not affect any legal rights or remedies you may have against the relevant seller of paid digital content.
19. Events Outside Our Control
We are not responsible for any failure or delay in performing our obligations under these Terms where that failure or delay is caused by an event outside our reasonable control.
Such events may include, without limitation: failure of hosting, network, power or internet infrastructure; denial-of-service or other attacks; outages or changes affecting Minecraft, Mojang/Microsoft services, Discord, Tebex or other third-party services we depend on; acts of government or regulators; industrial action; fire, flood or severe weather; and epidemic or pandemic.
If such an event occurs we will take reasonable steps to limit its effect and to resume normal operation as soon as reasonably possible.
Where the event prevents us from providing a paid Subscription for a substantial period, you may cancel that Subscription under section 14.2, and nothing in this section affects any statutory right or remedy you may have.
20. No Waiver
If we do not insist that you perform any of your obligations under these Terms, or if we delay in taking action against you in respect of a breach, that does not mean we have waived our rights against you or that you do not have to comply with those obligations.
If we waive a breach by you, we will only do so in writing, and that does not mean we will automatically waive any later breach by you.
The fact that a rule has not been enforced on a particular occasion, or has been enforced differently against a different person, does not prevent us from enforcing it.
21. Assignment
You may not transfer your rights or obligations under these Terms, or any Account or Virtual Item, to another person without our prior written agreement.
We may transfer our rights and obligations under these Terms to another organisation, for example if the operation of Haven SMP passes to a different operator. We will tell you in writing if this happens, through the Discord server, website or in-game announcements, and we will ensure that the transfer does not affect your rights under these Terms. If you are not content with a transfer, you may stop using the Services and cancel any Subscription in accordance with section 14.2.
22. Third-Party Rights
These Terms are between you and Haven SMP. No other person has any right to enforce any of these Terms under the Contracts (Rights of Third Parties) Act 1999.
This does not affect any right or remedy of a third party which exists, or is available, otherwise than under that Act.
23. Governing Law and Jurisdiction
These Terms are governed by the law of England and Wales.
If you are a consumer, you will also retain any mandatory protections provided by the law that applies to you, and nothing in these Terms prevents you from relying on mandatory rights or bringing proceedings in a court where you are legally entitled to do so.
24. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and, where necessary, treated as severed from the remainder of these Terms.
The remaining provisions will continue in force.
25. Entire Agreement
These Terms, together with the Rules and any other policies expressly incorporated into them, form the agreement governing your use of the Services.
Where there is an inconsistency between these Terms and a mandatory legal right, the mandatory legal right will prevail.
